Template: XTO Pty Ltd should have this policy reviewed by a lawyer before publishing.
This policy explains how XTO Pty Ltd ("XTO", "we", "us") handles personal information in connection with the 5090Ai desktop application (the "Software") and this website (the "Website"). We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).
The short version
- Your prompts, chats, documents and images stay on your PC. The AI models run on your own graphics card; we never receive what you type, the answers, or the files you add.
- The Software contacts our servers only to download model files, to sync the free daily prompt count, and to buy, activate or deactivate a license or make a donation.
- We don't sell personal information, and the Website has no advertising or tracking cookies.
1. Information processed only on your computer
Chats, prompts, answers, settings, documents and images you add to Knowledge, and their search index are stored only on your PC (in your Windows user profile). Web search, when you switch it on in a chat, sends search queries and page requests from your PC directly to search engines and websites; those requests are subject to those sites' own policies.
2. Information we receive
Free daily allowance
To apply the free allowance (up to 1,000 prompts per day for personal use), the Software sends our license server a machine identifier (a one-way hash derived from your Windows installation and system drive; it does not contain your name), the date and a count of prompts. No prompt content is sent.
Commercial licenses
When you buy a commercial license we receive your email address (for the receipt and license key), the machine identifiers of the PCs you activate, the license key, and the payment reference from Stripe.
Donations
Donations are processed by Stripe. We receive the amount, date and the details Stripe shares with merchants (such as the email address you enter at checkout).
Model downloads
Downloading model files from our server involves standard technical information such as your IP address and the files requested, which our hosting provider may log for operating and securing the service.
3. Payments
Card payments are handled by Stripe. XTO does not receive or store your full card details. Stripe's privacy policy applies to the information you give Stripe.
4. The Website
The Website does not use advertising or analytics cookies. It stores your light / dark theme choice in your browser's local storage. Fonts are loaded from Google Fonts, so your browser connects to Google's servers when you view the Website.
5. How we use information
We use the information above to provide the free allowance, deliver and validate licenses, process donations, send license emails, provide support, prevent misuse, and meet legal obligations. We do not use it for advertising.
6. Disclosure and overseas transfers
We share information only with service providers that help us run 5090Ai (such as payment processing, email delivery and hosting), or where required by law. Some of these providers (including Stripe) may store information outside Australia.
7. Security and retention
We take reasonable steps to protect the information we hold, and keep it only as long as needed for the purposes above or as required by law (for example, payment records).
8. Access, correction and complaints
You can ask for access to, or correction of, the personal information we hold about you, or make a privacy complaint, by contacting us below. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (oaic.gov.au).
9. Changes
We may update this policy. The date at the top shows when it last changed.
